Algemene Voorwaarden Jolanda Bayens.

1. Jolanda Bayens handelt en werkt uit naam van eenmanszaak Jolanda Bayens KVK 96059788
2. Door uw opdracht te laten uitvoeren door Jolanda Bayens is de opdrachtgever gehouden aan de algemene voorwaarden van Jolanda Bayens zoals omschreven op deze pagina.
3. De partij/persoon die Jolanda Bayens een opdracht geeft is de wettelijke opdrachtgever. Ook al is hij/zij een tussenpersoon en handelt hij/zij voor een andere partij.
4. Boekingen:Ik hanteer regels over boekingen. De doorgegeven beschikbaarheid blijft 24 uur geldig. Als ik na 24 uur niets van de opdrachtgever heb vernomen, ben ik vrij om een andere opdracht aan te nemen.
5. Als de opdrachtgever en ik een datum en tijd zijn overeengekomen, houd ik mij aan die afspraak en doe ik er mijn uiterste best voor dat de sessie/opname perfect verloopt. De opdrachtgever kan de sessie/ opname 48 uur van te voren kosteloos opzeggen. In geval van annulering 36 uur voor aanvang van de opname, zal ik 25% van de afgesproken kosten van de opname in rekening brengen. In geval van annulering 24 uur voor aanvang van de opname, zal ik 50% van de afgesproken kosten van de opname in rekening brengen. In geval van annulering 12 uur of minder voor het begin van de opname, zal ik 75% van de afgesproken kosten van de opname in rekening brengen.
6. Na opname en levering krijgt de opdrachtgever een factuur uit naam van Jolanda Bayens. Deze moet binnen twee weken en voor de vervaldatum voldaan zijn.
7. Indien de opdrachtgever zich niet houdt aan de betalingstermijn heeft Jolanda Bayens het recht de incassokosten plus het wettelijke bepaalde kredietpercentage aan hem/haar door te berekenen en indien van toepassing, de ingesproken tekst van ieder denkbaar medium te laten verwijderen. Eveneens op kosten van de opdrachtgever.
8. Tegen betaling van de overeengekomen tarieven heeft de opdrachtgever het recht om ingesproken teksten voor commercials één jaar te gebruiken. Bij langere uitzending is de opdrachtgever gehouden aan een meldingsplicht plus het betalen van een jaarlijkse repeat-fee van 50% van de originele prijs
9. In geval van een commercial moet de opdrachtgever vooraf aangeven voor welke radio- en/of tv-zender de tekst en/of opname gebruikt gaat worden en duidelijk aangeven of het om een lokale, regionale of landelijke zender gaat. Een lokale zender is een zender die in hooguit twee gemeenten officieel te ontvangen is. Een regionale spot is alles wat daarbuiten valt en binnen twee provincies te ontvangen is. Jolanda Bayens spreekt van landelijk als het gaat om meer dan twee provincies.
10. De opdrachtgever moet altijd aangeven waar een door Jolanda Bayens geschreven tekst/ opname voor gebruikt gaat worden en op welk medium.
11. Opdrachtgevers dienen een factuuradres op te geven, maar dit mag géén postbusnummer zijn. Alle prijzen zijn exclusief 21% BTW. De opdrachtgever dient de teksten compleet en foutloos aan te leveren. Uiteraard is het mogelijk een tekst door Jolanda Bayens te laten aanpassen. Hiervoor wordt van te voren een tarief afgesproken.
12. Alle teksten die worden aangeleverd moeten zijn voorzien van een duidelijke briefing wat betreft de tone of voice, uitleg bij uitspraak van niet reguliere woorden/uitspraken, lengte van de opname, technische specificaties. Indien de opdrachtgever onvoldoende informatie geeft, zullen retakes doorberekend worden.
13. Aangeleverde teksten dienen foutloos te zijn. Retakes door foutieve teksten zullen worden doorberekend.
14. Het is niet toegestaan om als demo/stemvoorbeeld bedoelde opnames te gebruiken voor producties en uitzending.
15. Het is niet toegestaan eerder door Jolanda Bayens ingesproken teksten te gebruiken voor andere producties, er nieuwe commercials/promo’s van te maken, of voor andere doeleinden te gebruiken dan waar ze oorspronkelijk voor zijn ingesproken.
16. Spreekfouten worden altijd kosteloos verbeterd.Jolanda Bayens

Terms and Conditions of Jolanda Bayens – Voiceover, Voice Actress, Copywriter1. General Provisions
1.1 Jolanda Bayens operates under the name Jolanda Bayens.
1.2 By assigning a project to Jolanda Bayens, the client agrees to the terms and conditions of Jolanda Bayens as outlined in this document.
1.3 The party or individual assigning work to Jolanda Bayens is the legal client, regardless of whether they act as an intermediary on behalf of another party.

2. Bookings
2.1 The availability provided is valid for 24 hours. If the client does not respond within this period, Jolanda Bayens is free to accept other assignments.

3. Appointments and Cancellations
3.1 Both parties must adhere to the agreed date and time for an appointment. Jolanda Bayens strives to ensure the session/recording proceeds flawlessly.
3.2 Cancellation policy:
• Cancellation is free of charge up to 48 hours before the recording.
• For cancellations between 48 and 36 hours prior, 25% of the agreed costs will be charged.
• For cancellations between 36 and 24 hours prior, 50% of the agreed costs will be charged.
• For cancellations within 24 hours, 75% of the agreed costs will be charged.

4. Payment
• 4.1 After the recording and delivery, the client will receive an invoice from Jolanda Bayens. Payment must be made in Euros (€) and transferred to the specified bank account within 14 days of the invoice date.
• 4.2 Any additional costs related to the payment, such as bank fees or currency conversion charges, are the sole responsibility of the client.
• 4.3 In case of late payment, Jolanda Bayens reserves the right to charge statutory interest and collection fees. If necessary, recorded materials may be removed from all media at the client’s expense.

5. Usage Rights
5.1 Upon payment of the agreed fees, the client is granted the right to use recorded materials for commercials (including online and social media) for one year.
5.2 For use beyond one year, notification and payment of an annual repeat fee of 50% of the original price are required.
5.3 Previously recorded materials may not be reused for other productions, commercials, or purposes without written permission.

6. Specific Applications
6.1 For commercials, the client must specify the media (radio, TV, online, and social media) and the region (local, regional, national) where the recording will be used.
6.2 Definitions:
• Local: within a maximum of two municipalities.
• Regional: within one province.
• National: more than one province.

7. Submission of Texts
7.1 Texts must be provided complete and error-free, along with a clear briefing on tone of voice, technical specifications, and other relevant information. Retakes due to insufficient information will be charged.
7.2 Retakes due to textual errors are at the client’s expense.

8. Use for AI and Synthetic Voices
8.1 It is prohibited to use recordings for AI machine learning, creating synthetic voices, or other AI applications without written consent.

9. Liability
9.1 Jolanda Bayens is not liable for indirect damages, such as consequential losses, missed savings, or business interruptions.
9.2 Liability is limited to the invoice amount of the specific project.

10. Force Majeure
10.1 In case of force majeure, Jolanda Bayens reserves the right to suspend or terminate the project without compensation.

11. Miscellaneous Provisions
11.1 The use of demo recordings as production material is not permitted.
11.2 The client is responsible for copyrights on music and sound effects used in the production.
11.3 Speaking errors will be corrected free of charge.

12. Travel Costs
12.1 Travel costs are charged at €0.23 per kilometer driven.
12.2 Parking costs are at the client’s expense.
12.3 Due to her physical condition, Jolanda Bayens holds a disabled parking permit. The client must ensure a nearby parking space is available.
12.4 All travel costs for assignments outside the Netherlands, such as train, flight, or boat transportation, as well as accommodation and meal expenses, are the client’s responsibility.

13. Governing Law
13.1 These terms and conditions, as well as all agreements, are governed by Dutch law.

Allgemeine Bestimmungen
1.1 Jolanda Bayens handelt und arbeitet im Namen des Einzelunternehmens Jolanda Bayens, eingetragen bei der niederländischen Handelskammer (KvK) unter der Nummer 96059788.
1.2 Indem der Auftraggeber Jolanda Bayens mit der Ausführung eines Projekts beauftragt, erklärt er sich mit den allgemeinen Geschäftsbedingungen von Jolanda Bayens einverstanden, wie auf dieser Seite beschrieben.
1.3 Die Partei/Person, die Jolanda Bayens einen Auftrag erteilt, gilt als der rechtlich verbindliche Auftraggeber, auch wenn sie als Vermittler handelt und im Namen einer anderen Partei tätig ist.

1. Buchungen
   2.1 Ich habe klare Regeln für Buchungen. Die angegebene Verfügbarkeit bleibt 24 Stunden gültig. Wenn ich innerhalb dieser Zeitspanne keine Rückmeldung vom Auftraggeber erhalte, bin ich frei, einen anderen Auftrag anzunehmen.
2. Termine und Stornierungen
   3.1 Wenn der Auftraggeber und ich ein Datum und eine Uhrzeit vereinbaren, halte ich mich an diese Vereinbarung und werde mein Bestes tun, um sicherzustellen, dass die Sitzung/Aufnahme perfekt verläuft. Der Auftraggeber kann die Sitzung/Aufnahme bis zu 48 Stunden vorher kostenfrei stornieren.
   • Bei einer Stornierung 36 Stunden vor Beginn der Aufnahme werden 25 % der vereinbarten Kosten in Rechnung gestellt.
   • Bei einer Stornierung 24 Stunden vor Beginn der Aufnahme werden 50 % der vereinbarten Kosten in Rechnung gestellt.
   • Bei einer Stornierung 12 Stunden oder weniger vor Beginn der Aufnahme werden 75 % der vereinbarten Kosten in Rechnung gestellt.
3. Zahlung
   4.1 Nach der Aufnahme und Lieferung erhält der Auftraggeber eine Rechnung im Namen von Jolanda Bayens. Diese muss innerhalb von zwei Wochen und vor dem Fälligkeitsdatum beglichen werden.
   4.2 Wenn der Auftraggeber die Zahlungsfrist nicht einhält, hat Jolanda Bayens das Recht, die Inkassokosten sowie den gesetzlich festgelegten Verzugszinssatz in Rechnung zu stellen. Gegebenenfalls kann die eingesprochene Aufnahme von allen denkbaren Medien auf Kosten des Auftraggebers entfernt werden.
4. Rechte an Aufnahmen
   5.1 Gegen Zahlung der vereinbarten Gebühren hat der Auftraggeber das Recht, eingesprochene Texte für Werbespots ein Jahr lang zu nutzen.
   5.2 Für eine längere Nutzung ist der Auftraggeber verpflichtet, dies zu melden und eine jährliche Wiederholungsgebühr von 50 % des ursprünglichen Preises zu zahlen.
   5.3 Der Auftraggeber muss im Voraus angeben, für welche Medien (Radio, TV, Online, soziale Medien) und in welcher Region (lokal, regional, national) die Aufnahme genutzt wird.
5. Haftungsbeschränkung
   6.1 Jolanda Bayens haftet nicht für indirekte Schäden, Folgeschäden, entgangene Gewinne oder Schäden an Dritten. Die Haftung ist auf den Betrag begrenzt, der für die jeweilige Aufgabe berechnet wurde.
6. Höhere Gewalt
   7.1 Im Falle höherer Gewalt, wie z. B. Krankheit, technischer Störungen oder anderer unvorhersehbarer Umstände, behält sich Jolanda Bayens das Recht vor, die Aufgabe zu verschieben oder zu stornieren, ohne für Schäden haftbar zu sein.
7. Nachbesserungen und Fehler
   8.1 Alle eingereichten Texte müssen vollständig und fehlerfrei sein. Wiederholungen aufgrund von Fehlern in den Texten werden dem Auftraggeber in Rechnung gestellt.
   8.2 Aussprachefehler werden immer kostenlos korrigiert.
8. Geistige Eigentumsrechte
   9.1 Alle geistigen Eigentumsrechte an den von Jolanda Bayens erstellten Texten, Aufnahmen und Materialien verbleiben bei Jolanda Bayens, sofern nicht schriftlich etwas anderes vereinbart wurde.
9. Nutzung durch Dritte
   10.1 Es ist nicht erlaubt, von Jolanda Bayens erstellte Aufnahmen ohne schriftliche Genehmigung für andere Produktionen oder Zwecke als die ursprünglich vereinbarten zu nutzen.
10. Anwendbares Recht und Gerichtsstand
    11.1 Auf alle Vereinbarungen zwischen dem Auftraggeber und Jolanda Bayens findet ausschließlich niederländisches Recht Anwendung. Streitigkeiten werden dem zuständigen Gericht in Noord-Holland vorgelegt.
11. Änderungen der Allgemeinen Geschäftsbedingungen
    12.1 Jolanda Bayens behält sich das Recht vor, diese Allgemeinen Geschäftsbedingungen zu ändern. Änderungen werden mindestens 14 Tage vor Inkrafttreten schriftlich oder per E-Mail mitgeteilt.

1. Dispositions Générales
   1.1 Jolanda Bayens exerce sous le nom de Jolanda Bayens.
   1.2 En confiant un projet à Jolanda Bayens, le client accepte les conditions générales de Jolanda Bayens telles que décrites dans ce document.
   1.3 La partie ou la personne confiant un travail à Jolanda Bayens est considérée comme le client légal, qu’elle agisse en tant qu’intermédiaire pour le compte d’une autre partie ou non.
2. Réservations
   2.1 La disponibilité communiquée est valable pendant 24 heures. Si le client ne répond pas dans ce délai, Jolanda Bayens est libre d’accepter d’autres projets.
3. Rendez-vous et Annulations
   3.1 Les deux parties doivent respecter la date et l’heure convenues pour un rendez-vous. Jolanda Bayens s’efforce de garantir le bon déroulement de la session/enregistrement.
   3.2 Politique d’annulation :
   • L’annulation est gratuite jusqu’à 48 heures avant l’enregistrement.
   • Pour les annulations entre 48 et 36 heures avant, 25 % des coûts convenus seront facturés.
   • Pour les annulations entre 36 et 24 heures avant, 50 % des coûts convenus seront facturés.
   • Pour les annulations dans les 24 heures précédant l’enregistrement, 75 % des coûts convenus seront facturés.
4. Paiement
   4.1 Après l’enregistrement et la livraison, le client recevra une facture de Jolanda Bayens. Le paiement doit être effectué en Euros (€) et transféré sur le compte bancaire spécifié dans un délai de 14 jours à compter de la date de la facture.
   4.2 Tous les frais supplémentaires liés au paiement, tels que les frais bancaires ou les frais de conversion de devises, sont entièrement à la charge du client.
   4.3 En cas de retard de paiement, Jolanda Bayens se réserve le droit d’appliquer des intérêts légaux et des frais de recouvrement. Si nécessaire, les enregistrements livrés pourront être supprimés de tous les supports aux frais du client.
5. Droits d’Utilisation
   5.1 Une fois les frais convenus payés, le client obtient le droit d’utiliser les enregistrements pour des publicités (y compris en ligne et sur les réseaux sociaux) pendant un an.
   5.2 Pour une utilisation au-delà d’un an, une notification et le paiement d’une redevance annuelle de 50 % du prix initial sont requis.
   5.3 Les enregistrements précédents ne peuvent pas être réutilisés pour d’autres productions, publicités ou usages sans autorisation écrite.
6. Applications Spécifiques
   6.1 Pour les publicités, le client doit préciser les médias (radio, télévision, en ligne et réseaux sociaux) et la région (locale, régionale, nationale) où l’enregistrement sera utilisé.
   6.2 Définitions :
   • Local : dans un maximum de deux communes.
   • Régional : dans une seule province.
   • National : dans plusieurs provinces.
7. Soumission des Textes
   7.1 Les textes doivent être fournis complets et sans erreurs, accompagnés d’un briefing clair sur le ton de voix, les spécifications techniques et toute autre information pertinente. Les retouches dues à un manque d’informations seront facturées.
   7.2 Les retouches dues à des erreurs dans les textes sont à la charge du client.
8. Utilisation pour l’IA et les Voix Synthétiques
   8.1 Il est interdit d’utiliser les enregistrements pour l’apprentissage automatique d’IA, la création de voix synthétiques ou d’autres applications d’IA sans autorisation écrite.
9. Responsabilité
   9.1 Jolanda Bayens n’est pas responsable des dommages indirects tels que les pertes consécutives, les économies manquées ou les interruptions d’activité.
   9.2 La responsabilité est limitée au montant facturé pour le projet concerné.
10. Force Majeure
    10.1 En cas de force majeure, Jolanda Bayens se réserve le droit de suspendre ou de résilier le projet sans compensation.
11. Dispositions Diverses
    11.1 L’utilisation des enregistrements de démonstration comme matériel de production n’est pas autorisée.
    11.2 Le client est responsable des droits d’auteur sur la musique et les effets sonores utilisés dans la production.
    11.3 Les erreurs de prononciation seront corrigées gratuitement.
12. Frais de Déplacement
    12.1 Les frais de déplacement sont facturés à 0,23 € par kilomètre parcouru.
    12.2 Les frais de stationnement sont à la charge du client.
    12.3 En raison de sa condition physique, Jolanda Bayens est titulaire d’une carte de stationnement pour handicapés. Le client doit veiller à ce qu’une place de stationnement proche soit disponible.
    12.4 Tous les frais de déplacement pour des missions en dehors des Pays-Bas, tels que les frais de train, d’avion ou de bateau, ainsi que les frais d’hébergement (nuitées et repas), sont à la charge du client.
13. Droit Applicable
    13.1 Ces conditions générales, ainsi que tous les accords, sont régis par le droit néerlandais.
